Banks Found Guilty Of Foreclosure Fraud! (Relationship to Mass Joinder Lawsuits

In the event this is your first time on my blog, http://www.yourremedyisinthelaw.com/  it may be useful for you to review some of my previous postings relating to the merits and evolution of the Nationwide Mass Joinder Law suits that have been filed in California Superior court. You should interpret this press release as just one further court ruling that strongly supports the following case #’s.

NOTE: The Mass Joinder suit is not confided to foreclosure fraud; it’s also designed to provide principal and interest reduction to those who are still in their homes.

As a result of the recent investigation launched by the Florida attorney general’s office, bank of America, GMAC bank, JP Morgan chase, and others, have all been found guilty of foreclosure fraud.

Depositions by the banks employees revealed that the banks have been forging, falsifying, and fabricating documents in order to foreclose on millions of homes owned by unsuspecting American homeowners.

Additionally, Wells Fargo Bank has admitted to 55,000 counts of perjury in submitting false affidavits to the courts in its efforts to fraudulently foreclose on homeowners.

To add to this disgusting, and arrogant display of lawlessness by the banks, nothing has been done by The Justice Department, or any other Federal Officials in the way of civil or criminal charges against the banks, until now.

Recently, The Arizona and Nevada Attorney Generals have filed a civil lawsuit against Bank of America for fraud against homeowners seeking loan modification, and hopefully there will be more lawsuits on the way, as the Obama Administration has also launched a Financial Fraud Enforcement Task Force to investigate and prosecute financial crimes in the lending and financial markets.

As bank fraud has already proved to be pervasive, let’s hope that this task force has the political will and integrity to prosecute the banks, and the corrupt attorneys who represent them.

These are essentially mortgages that the banks knew they did not own, but were willing to break the law in order to put homeowners out on the streets to satisfy their insatiable greed for even more money.

In spite of clear and convincing documented evidence, in the forms of deposition testimony by bank employees, the banks have been carrying on as if nothing ever happened, and federal officials have seemingly given them the green light to continue to break the law with impunity.

Until such time as The Department Of Justice, The SEC, And The Attorney Generals of each state decide to take action against these criminal banks, homeowners have no choice but to implement their own available legal strategies to fight to save their homes.

Because most of these foreclosure cases involve the banks inability to produce the promissory note in order to prove they have any legal rights to foreclosure, homeowners have several legal strategies available to them, in order to stop the banks from fraudulently foreclosing on their homes.

One of the more popular strategies employed of late is the “Produce The Note” Strategy. As a large percentage of mortgage loans were securitized, and sold to investors all over the world, it has been difficult, if not impossible for the banks to produce the required documents that would establish their right to foreclosure, as those documents have been lost in the Wall Street ether. This is why the banks have attempted to forge and falsify the documents, but have been recently caught, and found guilty of fraud.

Secondly, the homeowner can also file a civil suit against the banks for fraud, and make them prove they are the rightful owner of the note who is authorized to foreclose on the homeowner’s property.

Last, but definitely not least, is the latest, and possibly most powerful strategy available, which may not require a homeowner to go to court at all if they are not in a foreclosure. It is strictly an administrative process pursuant to the Administrative Procedures Act Of 1946, by which the homeowner is legally able to reconvey the property title back into his/her name, thereby revoking any authority by the bank to foreclose on the property, and taking the property back usually within 90 days. This effectively puts the homeowner back in control, and forces the bank to deal with the homeowner, who now is negotiating from a position of strength, instead of begging the bank for help.

Until such time as our Government Officials decide that they will uphold, and enforce the rule of law, and the U.S Constitution, and not allow themselves to be bought by the bank’s lobbyist, the American Homeowner must be willing to fight for their Constitutional Rights, and homes by any legal means necessary against the Federal Reserve, The Banks, and the wealthy Wall Street Barons, who created this mess with the full intention of fleecing the American Citizens from all of their remaining wealth in the form of equity in their homes.

1) Thou shalt not tailgate
2) Thou shalt not drive fatigued.
3) Thou shalt not drive distracted.
4) Thou shalt not drive more than 5 mph over the posted speed limit
5) Thou shalt not change lanes abruptly and without signaling.
6) Thou shalt not intimidate, terrify, or bully the "four-wheelers"
7) Thou shalt not sexually harass women truckers on the CB radio
8) Thou shalt not go three days or more without shaving, showering, etc.
9) Thou shalt not toss "urine bombs" on the roadway, or leave them, and your trash in a parking lot. (or anyplace, for that matter)
10) Thou shalt not drive faster than 3-5 mph in any truck stop.
11) Thou shalt not argue with Mother Nature, know when to take your rig off of the road.
12) Thou shalt not drive in a way that would reflect poorly upon your brother/sister truckers.
13) Thou shalt not dress in a manner that would reflect poorly upon the company you drive for.
14) Thou shalt not accept a dispatch that you know to be unsafe or illegal.
15) Thou shalt not steal from any fellow trucker, male or female.
16) Thou shalt not drive in any manner which could be construed as rude, unsafe, or aggressive.
17) Thall shalt not take on/off ramps faster than the posted speed limit.
18) If driving team, thall shalt not compromise your co-drivers safety or sleep patterns. Thall SHALL be courteous and respectful.

I thought I had posted this link....I shall post it again.  Keep in mind, that Judy's beloved dog, "Todd" was in the truck while that reporter stood right outside the door, talking about Judy's death.  Poor Todd!  When he was finally rescued,

that poor baby could not stop shaking, all the way from the ride from Bloomsburg, PA to Indiana.  

   Todd is doing better now, and the family has Judy's clothes and things with her scent on it to help comfort him.

Trucker hit, killed in lot

MIFFLINVILLE — A woman who returned to the trucking business after her husband died was killed early Tuesday by a hit-and-run driver at Love's Truck Stop here, State Police report.

Two other truckers found the body of Judith Stanton, 55, of Anderson, Ind., in the parking lot around 6:30 a.m., said Trooper James J. Surmick. She had been walking back to her rig from the Love's store when she died, police said.

Her pet poodle was still waiting for her in the cab of her truck when officers arrived.

Troopers weren't sure if whoever struck her knew she had been hit. Truckers have a lot of blind spots around their vehicles, noted Surmick.

The parking lot was dark, the weather poor and the road slippery when the accident occurred, he said.

Stanton appeared to have died of blunt force trauma, said Ron Taylor, Columbia County deputy coroner.

An autopsy was scheduled for this morning.

A rarity

In Indianapolis, Ind., news of Stanton's death hit hard, said Jamie Steele of Celadon Trucking Inc.

She had worked for the company for 19 years, a rarity in a business where drivers frequently switch employers, Steele said.

As a woman on the road, she was unusual. Only 10 percent of his company's 3,500 employees are female, and Celadon has the second-highest number of female truckers in the industry, he said.

She used to be part of team with her husband, Chuck, taking turns behind the wheel on their journeys. Chuck died about a year ago after leaving the road because of medical issues, according to Steele.

Judith returned to driving, this time with the dog as her only companion. Together, they would go out for three and four weeks at a time, hauling loads through all the lower 48 states and Canada.

"Because she had been with us so long, everyone knew her," Steele said. "And she was an excellent, excellent employee."

The company never received a single complaint about her in all her years of work. She was very outgoing, and people loved her, he said.

"She will be sorely missed."

Surmick said troopers cared for the dog until the SPCA took it to its kennel to await Judith's next of kin.

By 11:30 a.m., another Celadon truck had been diverted to Love's to pick up Judith's load and take it back to Indianapolis.

"It sounds cold," Steele said. "But we have to keep the load moving. We have to keep everything transparent for the customer."

The tractor will remain in the area until Judith's relatives decide if they want to collect her belongings themselves, he said. After that, the company will arrange to retrieve the truck.

Information sought

News spread quickly to fellow truckers.

Roger Scollon of Merrillville, Ind., said he got word of the fatal accident on his CB by 7:30 a.m. as he drove up Interstate 81.

Meanwhile, the Love's stop — on Route 339 just off Interstate 80 — remained busy. Truckers and cars pulled in and out past the State Police forensics van parked near the rig.

Troopers ask anyone with information about Judith's death to call them at 387-4261.

Being alone, Marmaduke straddled the dead man and proceeded have sex with him. Much to her surprise, the alleged victim came to orgasm after several minutes. A few weeks later, Marmaduke had a positive pregnancy test while receiving a routine medical exam. Upon telling her doctor the circumstances leading to the conception, the police were notified. Marmaduke was arrested without incident at her dilapidated trailer home a few blocks from the mortuary.

In a bizarre twist, Marmaduke plans to sue the dead man’s estate for child support.
